In 1994 a study was conducted by psychologist Fran Rauscher and physicist Gordon Shaw at the University of California to test the connection between music and math and science skills. The three test groups were comprised of three year olds. The first group participated in adult-led singing time, the second group, in weekly keyboard lessons, and the third (control group) was not exposed to any type of musical activity. The results were astounding! How to place your songs and music in film, TV and other media

These days, there is a great amount of good music being created and made available to the public. The internet has certainly been a great tool to that end. With all this music out there, today’s artists, songwriters and composers may feel that they are but tiny fish in a huge ocean. But there is a whole industry that exists that many people aren’t even aware of that makes this ocean a whole lot smaller.
Have you ever watched a TV show, commercial or a movie, or heard a radio commercial and wondered where the background music came from? Certainly there are scores of composers for hire who custom compose music on a per project basis. However, this can at times be too expensive for the project’s budget. As a result, there are two similar yet separate industries that exist to fill the need for pre-cleared hassle-free and inexpensive music, and each specializes in their own field.
1) Songs for Film & TV. The Pre-cleared Song industry will represent independent songs on behalf of the artist and pitch their material where appropriate. Uses include, films, TV shows and radio / television commercials. One of the places to promote your music for these uses is “museeks.com”. 2) Instrumental “Production Music”. The Production Music industry puts together collections of instrumental music and makes it available to the film, TV, and media industry for easy, hassle free use. Uses include films, TV shows and commercials, radio spots, documentaries hollister , corporate videos, multi-media presentations, and many others.
Songs for film, TV and commercials is a narrow niche that is extremely complicated in terms of negotiating a fee structure. Some of the considerations are as follows: Will the movie containing the song be a limited release film or will it be a general release across North America or the world? Will the video be released for sale or rent 6 months after the theater release? How many copies will be made, and in what territories will they be available? Will the film be translated into a foreign language in the future? Will it be shown as a re-run 5, 10 15 or 20 years from now on late night TV? Will it be shown on airlines as entertainment? Will the song be included on a “soundtrack CD” and sold in stores? Each of these uses has its own fee and must be itemized in the Contract, so it is best left up to people who specialize in this field to do the negotiating.
Basically, producers look for songs that are in sync with the same message that their production is trying to convey. For example, a song for a car commercial will have to project the image of freedom and independence, attitude, affluence or whatever other feelings they want you to imagine by owning that car. Similarly, songs for films or TV shows have to fit the scene where they will be used. I recently had a producer contact me who was looking for a sexy jazz vocal piece for a scene in a film where the lead actors were walking through a smoky bar. The music has to create the mood of the scene in the mind of the viewer. I have also had many requests for songs that were “positive and uplifting” without being religious. “America The Beautiful” is a prime example of this type of song.
Many people ask, “why don’t producers simply use popular songs from CD’s available in stores”? They can, but it will cost them a lot of time in securing permission as well as a considerable amount of money, because somebody owns the rights to that music. (Microsoft reportedly paid The Rolling Stones seven figures to use a small snippet of their song “Start Me Up” in a TV commercial). They could even be refused permission regardless of cost. Permission would have to be sought from two different parties; the publisher (owner of the copyright in the actual music) and from the record company (owner of the copyright in the recording).
Instrumental production music is similar to the song industry except that it is easier to get music placed as there are many more opportunities available. Production music companies press CDs of instrumental music (all styles) and offer it to producers in 3 different ways:
1) Blanket License – For an annual fee, the producer has the unlimited right to use the music on a lease basis for a specified term.
2) Laserdrop License – Music is made available to the producer on a “pay-per-use” basis, and he must pay a set fee each time he uses music provided by the company.
3) Buy-Out License – The producer purchases the CD’s of production music outright, and the purchase price includes the right to unlimited use of the music forever. In each of the above cases, the producer is still required to submit cue sheets and report usage to the appropriate performance rights society for all public performance of any production containing the music. This allows both the composer and the publisher to collect performance royalties. This reporting does not involve an additional fee to the producer.
What is “Copyright”? It is the protection given by the state (governing body of each country) to those who create intellectual property such as literary works, plays, musical compositions, etc. “Copyright” itself includes three separate and distinct rights:
1) Mechanical Rights – The right to make copies (tapes, CD’s, videos, etc) of copyrighted works. No person can make a mechanical reproduction of a copyrighted musical work without the permission of the copyright owner.
2) Synchronization Rights – The right to synchronize, re-record or utilize a musical recording in timed relation with a visual image or another sound or voice. This would include all forms of radio or TV commercials, shows, motion pictures, videos, etc.
3) Performance Rights – The right to perform musical works in public through radio, television, concert halls, restaurants and bars, background music systems (banks, grocery stores, elevators), and so on. Radio and TV stations pay an annual fee to the performance rights societies (such as BMI, ASCAP, SOCAN, PRS etc) for the right to perform music over the air. From the data that these societies receive from stations (i.e. cue sheets), the relevant composers and publishers get their appropriate shares of performing fees (residuals) which is paid out from the pool of funds collected. The performing rights societies are part of an international network of affiliates which exchange cue sheets and program information and collect and distribute performing fees to composers and publishers around the world.
What does it take to have your music considered? Here’s the Criteria:
* Your songs or instrumental music must be professionally recorded and mastered, and be of top quality.
* You must own your own Publishing, Copyright and Master Recording. In other words, you have not assigned these rights to any other person or company.
* You must have agreements/release forms with the producer, performers, studio etc that you control all rights and that they have no claim to any income that may be generated as a result of the performance or use of your song or instrumental music.
* You must acknowledge that your song or composition is completely original, and that you did not copy any part from any other source. All samples (if used in your music) must be pre-cleared and royalty-free.

The New Season Of Dancing With The Stars1

I just couldn’t stand to watch Chloris Leachman. But then along came Gilles Marini, Lil Kim, Ty Murray, Melissa Rycroft, The Woz, Julianne’s boyfriend, Chuck Wicks, Denise Richards, Shawn Johnson, and a few others that really didn’t interest me.
Despite that dreadful lineup, there was an individual that did make it all worthwhile. It was french actor Gilles Marini who pulled it all together for the eighth season of Dancing with the Stars I discovered Gilles when I saw Sex and the City where he stood out among a cast of talented actors and actresses. Just like in Sex and the City, he proved to be the best entertainment on Dancing with the Stars. Gilles raises the temperature on the dance floor. One of Dancing’s judges, Carrie Ann Inaba, let slip what a lot of us were thinking – Carole, Gilles Marini’s wife, one was lucky lady.
Denise Richards was a big disappointment, lacking talent as well as personality. The Woz may be a computer genius and he definitely seemed like a great guy, but he just didn’t have the moves on the dance floor. Chuck Wicks wins an A for effort with he tremendous work he put into his dancing which kept him around until near the end. I have to admit I never would have dreamed Lil’ Kim, who I knew very little about before the show, would turn out to be an incredible dancer and one of my favorite celebs. Derek Huff showed what expert choreography and showmanship can bring to the dance floor with his amazing routines. They were a team that showed talent as well as chemistry. How stunning was it then that Lil’ Kim was voted off ahead of several less talented dance partners.
So who did make it to the last couple of shows? It looks like it’s going to be Ty and Chelsie, Gilles and Cheryl, Melissa and Tony, and Shawn and Mark. With nearly no preparation Melissa replaced an injured Jewel just before shooting began this season. She showed immediately that she had ballet training. Her performances have been close to perfection, earning her perfect scores in the last show. Even if you get a perfect score from the judges, you still risk being voted off the show. (Just ask Sabrina Bryan, who was eliminated early in another season after receiving a perfect score.) Rodeo champion Ty Murry has worked on his dancing the most and it shows. He happens to be very adorable too. Ty’s experience riding bulls and guiding horses doesn’t translate directly to the dance floor and provided a big cache of voting fans who normally wouldn’t watch Dancing with the Stars. Shawn Johnson’s Olympic performance was so endearing, and her dancing is the same. And rounding this amazing cast of celebrities is Gilles Marini who didn’t make a move I didn’t absolutely love.
Who will bring home the trophy? Another couple goes home this week. After that the three last dance teams have a final dance-off. I can’t wait until the final show airs! Luckily I have a DVR for a backup just in case something comes up.
Getting your Dancing with the Stars fix in high definition is the greatest way to do it I’ve found. Recently my son convinced me to ditch my regular TV and make the jump to an HDTV. I didn’t know what I was missing! You may be thinking what I used to think – how can it make that much of a difference in picture and sound quality? Well, I’m here to tell you it really does. Some say U2 is the best band of all time. Often it is Bono that is saying that, but nonetheless, he has a point, check out this list of the best U2 albums:
“Unforgettable Fire” The album that turned U2 into a band to be reckoned with, the band intentionally set out to try new things so that they wouldn’t turn into another boring arena rock band when they hired Brian Eno and Daniel Lanouis to produce the record. Eno didn’t have much experience in rock record producing but agreed to do it if the band really wanted to take their sound in new directions. They did, and the result was one of the band’s best records, with Edge’s shimmering guitar chords front row center and Bono’s usual vocal theatrics and earnest lyrics beaming.
“Pop” During their Pop Art phase, U2 got a lot of flack for being overindulgent and intentionally vulgar with their over the top live shows and Bono’s multi-persona characters he would bring out during songs. There was a certain theatricality of the band during this time, with the band wearing wigs, doing funky moves, throwing a poker chip set into the audience to make a point about consumer culture… Looking back, the album “Pop” and the PopArt Tour that followed were some of the best times for the band, where they were able to step back and sort of laugh at themselves and the world, instead of always preaching and crying about the troubles of life. Sometimes you have to smile a little and remember that as horrible as life can be, as ruthless as humanity is to each other, there is some good in it, and there is something to laugh about, always.
“All That You Can’t Leave Behind” U2 returned with a vengeance with this mature and stately set of arena-rock songs that solidified them as not only one of the most important bands of the 80s and 90s, but of the 00s as well. With the huge hits of “Beautiful Day” and “Elevation” they opened themselves up to a new league of young fans who had never heard of them before, but because of this record, they went back and bought all the band’s old material (myself included.)

Most young musicians benefit from the aid of a quality music instructor. An experienced instructor has “been there and done that” on their particular instrument and can serve as a good road map for a student that is willing to learn from the experience of another. This is one of the most valuable benefits of a music teacher. It’s not that a student can’t learn on their own by mimicking recordings or using books, rather, utilizing a good teacher can eliminate a large portion of trial and error a student will experience on their own.
Picking the right teacher.
Finding the right music teacher can be a frustrating task for the music student. For the student that is just learning and doesn’t know what direction to go or what teacher will be a good fit for him or her, here are some tips in this area:
Get recommendations from local music students that are doing well on their instrument. Everyone knows someone who is talented on their instrument. Ask that person who they take lessons with or who they might recommend. You might even consider taking lessons with that individual you know to be a good player. Realize, however, that just because someone is a good player does not necessarily make them a good teacher. Take a couple trial lessons at first before you commit to them long term.
Check with local music schools or University music programs. These institutions are usually quite picky with their list of music teachers. In areas well known for having good music programs such as New York, Los Angeles, Utah and other places, there are several award winning music schools, programs and organizations to inquire about. Each area has its own unions and music resource organizations. The musician’s union is a good source for Music teachers in Utah. Utah Music Teachers is another source for music teachers, music schools and University music programs.
Make sure when you pick your instructor you chose a music teacher that will be a good fit for you or your student. A saxophone teacher that focuses on the classical genre would not be a good fit for a student interested in Jazz Studies. A student that has large aspirations should not be fit with a teacher that will not push them in terms of practice time and intense lessons. Similarly, a student that only has a mild interest in music and will not put in a large amount of practice time would not be happy with a teacher that has unrealistic expectations of them.
Overall, pick a teacher that you are comfortable with and that you think you will have a lot of fun with. Music should be an enjoyable hobby at any level of playing. Good luck!
